We explore an ongoing case where federal agents operating under color of law and an unproven presumption of crime, seized control of and liquidated a company's assets worth more than $100 million dollars. The assets were owned and operated for the benefit of 600+ Lenders who enjoyed a guaranteed return of at least 12% per year. Without material proof, the Commodity Futures Trading Commission (CFTC) claimed that the Company operated a Ponzi scheme. Without legitimate authority, the CFTC seized control of the Company and all its assets, stripped its Partners of any ability to defend themselves or the assets and drove many of the lenders into desperate circumstances. After a seriously flawed criminal conviction of the Company CEO, Michael DaCorta, nearly 5 years after the civil case was opened the CFTC was granted Summary Judgment despite the fact that there exist more than 45 facts in dispute.  The criminal case is on appeal, the civil case will most likely soon follow suit. 

Over the course of its 8+ years of operation the Company consistently met it obligations to lenders and returned more than the minimum 12% promised earnings year after year.  Until the government interrupted it in April of 2019, it enjoyed a spotless reputation and an outstanding record of earnings from each of it several diversified investments, which included appreciating residential real estate, income-generating condominiums and businesses, appreciating precious metal holdings, an office fronting a deepwater Florida dock, and foreign exchange trading fee collections.  Prior to the CFTC's complaint, no other complaint of any kind had ever been filed against the Company.

This is the story of civil asset forfeiture, the worst inversion of American law on the books.  With it, government authorities are able to charge a property, seize, and liquidate it without any crime having been committed.  In the words of Senator Rand Paul (R-Kentucky), Civil Asset Forfeiture is the government's license to steal.  It can easily happen to you.
